UTIL Update

Dear UTIL members:

On August 4, 2023, at 2:00 pm, the Union was advised that UTIL Canada had filed an assignment in bankruptcy and KSV Restructuring Inc. was appointed as the Licensed Insolvency Trustee (“Trustee”) of the Company’s bankrupt estate.

That same day, as you are aware, employees were provided termination of employment and benefits effective that same day.

While we know that this has left a huge distaste in our members mouths, Unifor was approached by KSV in an attempt to restart the operations.

In order to operate the business, KSV as receiver, negotiated with Unifor the basis on which it will operate the business.

Restarting operations provides opportunities for our members.

    • Immediate Employment that may result in continued permanent employment,
    • No loss of E.I entitlements,
    • Offsetting potential losses through the bankruptcy proceedings (by enhancing company value),
    • Incentive monetary bonuses,
    • The possibility of new ownership with new management, and
    • Successorship opportunities of our hard-fought rights and obligations under your collective agreement.

Over the long weekend, the Union has been meeting with KSV Restructuring regarding the future of UTIL Canada and our members. There was discussion of potentially resuming production in some capacity to fill existing orders.

It is very important to take any recall that comes available. Not accepting a recall could lead to a denial of future EI entitlement.

If not recalled within 7 days from termination, you should apply for financial assistance from EI and WEPP thru Service Canada. A claim must be started within 28 days.

 

We are in a period of uncertainty, but rest assured, we are doing everything in our control to make sure everything is done to help our members.

Local 112’s intention is to have the current CBA honored as well assist those members when needed. We are providing information directly on our website that will be updated as new information becomes available. https://www.unifor112.ca/units/util-unit/ .

Subject: Util Decision to Declare Bankruptcy

Hello Util Sisters and Brothers

We were very disappointed to hear the decision from Util to declare Bankruptcy at their Canadian operation located at 270 Spinnaker Way. The fact that the company had made this decision well in advance and provided no notice to the Union until 130pm today is totally unacceptable. We have contacted Our National Union and Unifor’s legal team who will be working on the issues and baring a resolution, will assist us to make sure all members get everything you are owed . We will be reaching out early next week with further updates.

Once again we are very disappointed in the fashion this took place and are going to everything possible to rectify this situation.

Subject: Util Ratification Meeting Sunday June 12/2022 at 3pm

Good evening Util Sister’s and Brother’s

Your Bargaining committee has reached a tentative agreement with Util Canada. We will be holding a Ratification Meeting/Vote this Sunday June 12th at The Unifor Local 112 Union Hall, Located at 30 Tangiers Rd Toronto Ont.

The Meeting will start at 3pm followed by a ratification vote on the tentative agreement.
